Biden’s DOJ Fines Tennessee Christian Trucking Company $700,000 for Requiring Workers to Disclose Legal Status

Biden’s Department of Justice has slapped a whopping $700,000 fine on Covenant Transport Inc. and the affiliated Transport Management Services LLC, both stellar examples of Tennessee’s robust transportation sector.

The recent decision by the Department of Justice (DOJ) to impose a $700,000 fine on Covenant Transport Inc., a Christian trucking company based in Chattanooga, Tennessee, raises significant concerns about the overreach of federal power and the disregard for the realities faced by businesses in regulating their workforce.

The DOJ, under Joe Biden’s regime, claims this measure is to resolve alleged violations of the anti-discrimination provision of the Immigration and Nationality Act (INA) by Covenant and its affiliated entity, Transport Management Services LLC.

The department accuses Covenant of discriminating against non-U.S. citizen workers by requiring specific documentation to confirm their legal status to work in the United States.

  1. It’s a Catch 22.

    Hire someone with bad documentation or missing info and employer is on the hook. OTOH, as pointed out, there are several different types of documents which qualify as valid to permit hiring. But it’s choice of prospective employee which they offer as proof. Trucking company ran afoul of the law by specifying which types of proof they would accept, and rejecting other valid proofs. So settling was far cheaper than cost of litigating against deep, deep pockets of an angry corner of DOJ.

    Had similar but different experience over 25 years ago with same DOJ subset concerning a single applicant who had a temporary work authorization expiring shortly. Had a required federal license for job but no actual relevant experience. Long training period if hired and we didn’t sponsor applicants. Better candidates available even if applicant in question was US citizen. We prevailed, without court or settlement but it required some heavy lifting and took time to get our story and facts to register with novice Fed assigned to case. Could have become expensive in a hurry otherwise.

  2. hell they have drivers out there now that cant read or speak english, the dispatchers send them messages by way of cell phone, if they get pulled over they give the phone to the police and the dispatcher talks to the cops

  3. Th government requires us to submit an I-9 form, it asks the question of their legal status there. How do we know that they are legit unless we get more documentation? We had a guy working with us who had a fake identity. We found out later he was not who he said he was. The government is not checking these people and we are liable for them while they are on the clock.
