Letter to Virginia Attorney General’s Office: Request for AG’s Opinion on Maryland’s Attorney General Memo 10/15/2025 Regarding 287g / Immigration Enforcement

Hello Attorney General Miyares:

I respectfully write to your office Mr. Attorney General & leadership in the commonwealth of the great State of Virginia out of  Richmond asking for your potential assistance for your neighbors in Maryland.

 
On October the 15th of this year Maryland’s Attorney General Anthony Brown released a memo on the issue of
“Guidance for State and Local Law Enforcement Agencies Working with Federal Agents”

The Attorney General released this memo, it appears in response to certain Counties in Maryland wanting to adopt the 287G program, to help better coordinate with Immigrations Customs Enforcement (ICE) on the issue of “illegal immigration.”

The Ag’s memo states that ” Maryland officers may not enforce civil immigration laws or assist federal agents in enforcing such laws” in addition ” Maryland officers are subject to civilian oversight in misconduct matters and face substantial exposure to civil liability for violations of State or federal law.”

This “heavy handed” regulatory memo from the Attorney General, appears to be a threat to all law enforcement in the State of Maryland. A way through regulations almost to make it impossible for State & local law enforcement in Maryland to coordinate this federal agency.

So we are asking for assistance from  Attorney General Miyares office to look into this memo, and its opinion: does this “have standing?”  In addition to the State Language vs Federal Language, where the Federal says “Law Enforcement Officer” and the State is saying “Correctional Officer”.
