As RedState reported, Republican senators held a press conference on Wednesday, and what they revealed about the Arctic Frost scandal was incredibly disturbing. Describing it as “worse than Watergate,” Sen. Marsha Blackburn (R-TN) presented evidence that 92 different conservative organizations or individuals were targeted by Jack Smith and the Biden-era Department of Justice.
All of this was done under the guise of going after President Donald Trump over the 2020 election, and eight GOP senators also had their phone records subpoenaed, among other intrusions. That’s where things get even crazier. According to Sen. Ted Cruz (R-TX), infamous left-wing Judge James Boasberg was near the heart of this scandal, helping the Biden administration cover its tracks.
If you aren’t familiar with Boasberg, he’s the same judge who tried to hold the Trump administration in contempt for not magically turning around planeloads of illegal immigrants that had already taken off and left U.S. airspace. That would eventually be vacated on appeal, with Judge Neomi Rao chastizing Boasberg for threatening contempt over an order he never had the power to enforce in the first place.
The district court used the threat of criminal contempt to coerce the Executive Branch to comply with an order it had no authority to enforce. And it directed that coercion toward the Executive’s exercise of its foreign affairs power. The significance of the district court’s error, coupled with the potential for abuse in future cases, justifies our intervention at this stage of the proceedings. Considering the “totality of the circumstances,” the writ is appropriate.
