MSP Arrests NY Man In Connection With Possession and Transport of Unstamped Cigarettes

(Salisbury, MD) – Maryland State Police arrested a man from New York in connection with the possession and transport of unstamped cigarettes.

Carl G. Baley 54 of Arverne, New York was arrested on November 6, 2023. Baley is charged with Possession of Unstamped Cigarettes and Transport Unstamped Cigarettes along with various traffic citations. Baley was processed at the Salisbury Barrack and later transported to the Wicomico County Corrections Center.

On November 6, 2023 at approximately 8:30am, troopers from the Salisbury Barrack conducted a traffic stop on a white Volvo bearing Delaware registration in the area of Route 13 and Zion Road, Salisbury, Maryland. Upon contact, a large number of cigarette cartons were observed in plain view in the vehicle. Upon questioning the driver, it was learned the cigarettes were purchased in Virginia and being transported to New York. The cigarettes were found to have Virginia tax stamps on them. As a result of the arrest, the 200 cartons of cigarettes seized had a total value of $21,400 which is a $7,500 tax loss to the State of Maryland.

The Maryland Alcohol, Tobacco, and Cannabis Commission was contacted and responded to assist with the investigation. The investigation continues.

  1. How can MD charge or state tax loss when he was passing through the state. Can we not transport things from 1 state to another now? I understand if DE wanted to impose tax loss or Ny impose tax loss but how does MD do this from a traffic stop?

  2. What am I missing here? They were bought in Virginia and were to be sold in NY. Didn’t know MD charged a tax for passing thru! Seems to me Md is doing NY’s dirty work for free.

  3. The only places that should be interested is New York…the intended destination.
    This is a violation of the interstate commerce act…. The alleged perpetrator should be able to win this through SCOTUS…..

  4. What a load of crap! How is it a tax loss to Maryland? The cigarettes were neither purchased in Maryland nor sold nor intended for sale in Maryland. Following this logic any taxable commercial product passing through Maryland is contraband and should be seized.

  5. Whew, I’m glad they got em’. Don’t worry about all that fentanyl coming across our border. It’ll work itself out, but cigarettes, that a real threat.

  6. That’s nice work MSP. You kept cigarettes bought in Virginia from hitting the streets in New York. Lets see if you can actually do anything for Maryland. Now how about rounding up the illegal aliens and deporting them. How about getting rid of the violent street gangs. (both domestic and foreign) How about locking up pedophiles. How about doing something about all the car thefts and carjackings. When you are finished patting yourselves on the back for stopping the Great Cigarette Caper of 2023. Tell me about what you are doing about Illegal Drugs.
