A judge has dismissed a lawsuit brought by a number of business owners, religious leaders and other residents against Maryland Gov. Larry Hogan that argued Hogan’s executive orders aimed at combating the COVID-19 pandemic were unconstitutional.
U.S. District Judge Catherine Blake granted the state’s motion to dismiss the case Wednesday, writing that “based on the allegations in the
plaintiffs’ amended complaint, the court cannot conclude that Governor Hogan’s measures are arbitrary or unreasonable, or that they plainly violate any of the plaintiffs’ constitutional rights.”
The lawsuit was filed in early May, arguing the orders violated the First, Fifth and Fourteenth Amendments of the U.S. Constitution as well parts of the state constitution. On May 20, the court denied a request for a preliminary injunction in the case, saying the plaintiffs didn’t show the orders “lacked a real or substantial relation to protecting public health” and invaded their rights.
Among the plaintiffs are Republican Delegates Dan Cox, Neil Parrott and Warren Miller. The lawsuit also named the since-retired deputy health secretary Fran Phillips, Health Secretary Robert Neall and Maryland State Police Superintendent Woodrow Jones, III., as co-defendants.
Cox had said officials had threatened to arrest him if he attended a Reopen Maryland rally in Frederick County on May 2, which violated Hogan’s March 17 executive order.

Hogan worst Maryland Governor in history hope he never wins another election and is removed from politics and moves to another state. He only knows to come to the Eastern Shore when there is a seafood festival or food period. He has never had an original idea of his own I think he just tries to follow Como of NY on his every word. Will someone please state anything he has done for Maryland since his first term and now he has a second term. For one bring back the death penalty in Maryland that would be a start, clean up the bay and Wicomico River. Tear down slum city looking buildings in this state, make it a law that businesses need to clean up the outside of their buildings so that we may attract people to our cities. There are businesses in Salisbury that haven’t been painted in over 30 years or never and do we really need all of Rt 13 North to be “tire” businesses with stacks of tires for a landscape. What happened to downtown Salisbury it was going to be revitalized and restore our old historic buildings then they were tore down and the brilliant thought was a high rise on Main Street for college students. If we have a mayor whom accomplishes nothing then the Governor needs to take a look. I will say since “fake Jake is not around whoever is in charge is doing better job getting the roads repaired and able to drive on without braking axels. Salisbury looks better in Jake’s absence than it has done with him here. The city is even checking on abandoned houses, back alleys, and writing up landlords. Can we make this person in charge our full time mayor?
And there you have it folks, As illegal and unconstitutional as his orders are, since they are not law and I can name at least 10 US codes and statues along with he constitution he is violating, but do you all really think you will win in a corrupt court??? Especially since they are trying to use a health issue to take your rights??? Other states have had judges who let the lawsuits go through (so what does that tell you, it has merit!!!!), but your problem here is you went to the state, you need to go to the FEDERAL level!!! Because I can tell you for certain there are no laws on the books anywhere about a pandemic being the sole reason to have executive orders brought… Under law there is no classification that give any govt entity the right to use a pandemic as a health issue to enact said orders! They literally, physically and lawfully have no right to shut down any businesses or churches and the like! Just becasue you have corrupt courts and judges who are evil and what not does not make what the govt is doing legal and lawful… Especially Hogan!
