Senate Bill 355 was introduced on January 16 during the 2024 Maryland legislative session to
make it a criminal offense to display obscene material to minors in public schools. Although we have obscenity laws already established (Maryland State Criminal Law Code Annotated §11-201, § 11-202, § 11-203) and federal), public schools exempt themselves from obscenity laws under the guise of education. Therefore, SB355 is much needed to protect minors from adults that exploit these laws and expose minors to obscenity. Obscenity is not protected under First Amendment rights to free speech.
