WCBOE Violates Citizen’s Rights and Bans Him From Future Meetings

A citizen showed up to the Wicomico County BOE meeting on June 13, 2023 to express his First Amendment right to redress his grievances before his county government over their absolute integration of discriminatory CRT ideology that is critical of race, religion, discriminatory hiring practices, disproportionate discipline by race, and defining divisive social classes, while establishing a system of sexual and gender identity indoctrination throughout Wicomico County Public Schools. Some people didn’t like what the citizen had to say, so they had him removed by an officer and sent him a letter on June 23rd reprimanding him for violating board policy and banning him from returning to a future board meeting.

Here is the letter sent to the citizen reprimanding him and banning him from future meetings.

The Public Comments Protocol Policy was created just weeks after the DPTC first exposed the use of sexually explicit materials in the school. The WCBOE did not like the exposure, so the prior school board wrote this abusive policy to obstruct the citizens and violate their First Amendment rights. Since its creation, even more CRT ideology and obscene materials have entered the school system, while further circumventing process and accountability. This public comment policy was crafted to prohibit a citizen from displaying or holding up a poster, sign, book, class assignment, or video, and regulates a citizen’s volume, tone, language, actions, and demeanor. The policy also demands respectful acknowledgement for individual differences, diversity, personal, civil, and property rights of others, while the board and its administration are exempt from such.

Upon questioning some board members, they were unaware of any letter being sent to the citizen. The board did not authorize the letter, nor were the citizen’s comments construed as a threat. It was an internal job conspired by the Superintendent and board Chair Gene Malone who acted unilaterally without board approval. Legally, the board can only act as a corporate body, and no individual board member has any authority to take official action on behalf of the board. The board Chair can act as a spokesperson for the board, but his or her position must be of the majority. Either way, such an unauthorized action against a citizen would have no legal force or effect, and would not be legal if they did. The letter to bully the citizen was sent out on board letterhead with all members listed at the top. Gene Malone circumvented the board and illegally signed off on their behalf, and has now made all liable for these civil abuses.

There was absolutely no purpose in sending such a letter ten days after the meeting, other than to harass and intimidate a citizen. Who made Gene Malone arbitrator, judge and jury of the First Amendment? Gene Malone should resign immediately not only as Chair, but his seat. This would also call for the resignation of Superintendent Micah Stauffer who ordered the letter to be drafted. You can contact the board members below and ask them to abolish this abusive Public Comments Protocol Policy that the majority of the newly elected members vowed to get rid of during their campaigns. You can let them know how you feel about the mistreatment of citizens they are supposed to represent.

  1. Shocker …. Lean, mean , Gene the dancing machine making his own rules and the supt. Sucking his thumb, trailing his blanky, and following right along.

    A complete s$&t show.

  2. Robert Johnson

“You have 6 days and that’s not from me that’s from the most high. I’m just his messenger.”
If you had just read the quote and asked me to guess who said it I would have guessed Hunter Biden.

  3. Shame in this day and age, people who think they have power, feel the need to do whatever without repercussions. Maybe in the 20th century, but sure as hell not now.

    Idiots.

  4. THis loser made direct threats to public officials…if anything, the board has standing to sue him…he’s also a closeted pedophile like Darren Lombardo….

    1. Let’s go for curtain number 3 deformation of character and slander , violation 1st amendment, 14th amendment and state laws keep throwing mud ,I’ll keep building a case.

    2. I know him personally, youre a bitch biding behind a computer. Tell him that in person and grow some balls, coward

  5. gene malone always was and always will be a pos! think of dog shit on your shoe!!.
as for the wcboe, dont know how many times I would go to board meeting and nothing but a handful of parents showing up. so you get what you deserve! shame you children have to pay the price for your stupidity and ignorance!

  6. If the parents in this county send their children to public schools here in Wicomico County, you better keep an eye on these people who are suppose to be taking care of our children. I would never send my children to the
schools system with such a bunch of pansies trying to run the system their way. Waking up parents, look around and see what is happening to our children, to see what is being shoved down our children’s throats.
We need all parents to pack up and go to the next board meeting. Let’s see who gets elected next.

  7. First, words (these “threats”) are protected by the First Amendment. Unless, at the time, there was reason to believe the person was capable of carrying it out (like an assault). Offering to hold someone accountable through recall vote, petition, or even picketing, is not a threat of harm.

Secondly, WCBOE Policy is not a law. Hence the word “Policy”. Policy binds them and anyone that agrees to it in fact or tacitly.

Third, the WCBOE is a Government Entity. The first two letters being “Wicomico County”. They are tax exempt and a part of the Wicomico County Government. They are a part of the Wicomico County Retirement System to further support this statement.

The Supreme Court has ruled time and again that Government entities, no matter how much they may “feel” threatened or intimidated by a person, has no right to silence a person’s free speech. They also have no right to trespass someone from a public area of a public building. That would include conference areas, et al. You have violated his rights under the Fourteenth Amendment too. You have acted as judge and jury, by not allowing him representation by a lawyer before handing out your punishment.

Wicomico County citizens. Your illustrious BOE has just opened its’ pocketbook to a lawsuit that each of you will pay for. You better get these people in check before they cost you more.
